Kuryanin lost the court for 69 thousand rubles because of the signature for the tachograph card

Sudzhansky district court of the Kursk region has completed the consideration of the dispute between a private entrepreneur and an individual. The proceedings concerned the recovery of debts for services rendered, as well as the counterclaims of the defendant on the invalidation of the contract.

According to the materials of the case, an offer agreement was concluded between an individual entrepreneur and a chickenman. It was about the inclusion of a citizen in the list of insured persons under the collective insurance program. The document was executed using a simple electronic signature - a special SMS code, which was received by the defendant's phone number.

Services were performed - the entrepreneur transferred the insurance premium to the insurer. However, the individual did not pay. Subsequently, the rights to claim the debt passed to the agency under the assignment agreement. The debt amounted to 69 700 rubles, which was the reason for going to court.

After studying the circumstances, the court found that the contract was signed with a simple electronic signature. This signature is not related to a qualified one, which was produced later for other purposes - the registration of the tachograph card. Therefore, it was impossible to use it during the period specified by the plaintiff. This was the basis for refusing to recognize the transaction as invalid, the press service of the court said.
