Student raped after drug poisoning and left to die in dorm

In New York, a 19-year-old man was accused of raping a student who lost consciousness after using a drug and subsequently died. According to investigators, the man brought a dangerous ban to the hostel, passing it off as another drug, and persuaded two girls to take the substance. Both fainted almost immediately.
Instead of seeking help, the accused allegedly sexually assaulted one of the victims and then sent photos of them to friends. The second woman was rescued by doctors.
As reported on October 15, the Federal Prosecutor’s office of the Southern District of New York, defendants in the criminal case were 19-year-old Moses Freire from the Bronx and 18-year-old Brian Peralta Cabrera from Queens. The young people are accused of conspiracy to distribute a drug that caused the death of one person and serious harm to the health of another. Freire was further charged with distributing a prohibited substance that led to the death of the victim and transferring a drug with intent to commit rape.
The tragedy occurred on March 18, 2026 in a student dormitory in Manhattan. According to the new indictment, Freire arranged in advance with Peralta Cabrera to purchase a potent drug for the two girls.
Investigators found that Freire wanted a drug that would last all night. Moreover, he discussed the possibility of causing drug addiction in students. In correspondence, such a prospect was called beneficial for participants in the proposed scheme. Peralta Cabrera, according to the prosecutor's office, knew about the intention of the acquaintance to transfer the ban to the girls and gave him a drug.
On the evening of March 18, Freire came to the dormitory where the students lived. He assured the girls that he brought a pure narcotic substance that did not contain dangerous impurities. Meanwhile, according to the materials of the investigation, the young man himself called the purchased tool fake and poisonous.
After using the drug, both students almost instantly lost consciousness. Freire himself, according to prosecutors, did not take the banned substance that evening.
Further events formed the basis of a separate charge of sexual assault. The investigation alleges that the young man took advantage of the helpless state of one of the girls and raped her directly in the dormitory room.
He was not in a hurry to seek medical help. According to the prosecution, about 45 minutes Freire remained near the students who lost consciousness. During that time, he took pictures of them and sent them to other people.
Only after that, the young man turned to the security staff of the hostel. However, he initially hid the circumstances of the incident, saying that the girls allegedly drank too much alcohol.
The guards provided emergency assistance to the victims, including the drug used in poisoning with certain narcotic substances. Both students were rushed to Manhattan hospitals.
Doctors managed to save one girl. She regained consciousness after intensive treatment. The second patient was in critical condition and never woke up. She subsequently died from complications caused by acute drug poisoning.
The results of the toxicological examination confirmed that both victims used a dangerous narcotic substance. Traces of another tool that Freire allegedly offered them were not found in the samples studied. Thus, the results of the analysis confirmed the version of the investigation that the students were misled about the composition of the ban.
The new indictment contains three counts. Both defendants are accused of participating in a conspiracy to distribute a drug that caused death and serious harm to health. Freire is also accused of directly transferring the substance to the victim and of using the drug to commit a sexual offence.
Under U.S. federal law for the distribution of drugs with such consequences is punishable from 20 years in prison to life imprisonment. The additional charge against Freira for alleged intent to commit rape carries up to 20 years in prison.
The investigation was conducted by the US Drug Enforcement Administration and the New York Police Department. Experts in digital forensics and electronic data analysis were involved in the study of evidence.
The names of the injured students, the Prosecutor’s office did not disclose.
