In Yelets, the court refused the driver to recover 143 thousand rubles after an accident

The Yelets city court refused to pay damages after the accident, as it turned out that damage to the car, for the repair of which demanded money, appeared in another accident a few years ago.

As reported in the joint press service of the judicial system of the Lipetsk region, the accident occurred in November 2024. The driver of the FAV car collided with the Fiat Dukato, owned by the plaintiff. The insurance company paid the owner of the damaged car 25 thousand rubles, but he considered the compensation insufficient and went to court.

The plaintiff demanded to recover from another driver 142.9 thousand rubles. This amount included the alleged damage, the costs of representative services, state duty and payment for expertise.

During the trial, an autotechnical examination was appointed. The expert found that the damage, for the elimination of which the owner of Fiat expected to receive additional compensation, arose as a result of another accident that occurred three years earlier.

The court concluded that the plaintiff had not proved the need for additional repair costs and refused to satisfy the claims. At the same time, he will have to pay for a forensic examination worth 40 thousand rubles and the services of a representative of the defendant - another 20 thousand rubles.
