The doctor published a photo before and after plastic surgery without the consent of the client – had to answer the medical center

In the personal account of the doctor were posted pictures of the client before and after plastic surgery. Who is responsible for this, explained in the National Center for Personal Data Protection, writes sb.by.

A woman complained: she found her photos before and after the plastic in the instagram account of the doctor of the medical center. She did not give permission for publication.

The center drew attention to an important nuance: the doctor kept an account as a professional and positioned himself as an employee of the medical center, and the blog described the services. In this regard, the medical center was obliged to obtain consent to distribute such images, experts stressed.

However, the operator insisted that the responsibility lies with the doctor, since the account is his personal. However, given that the content is directly related to the services of the medical center and is aimed at attracting customers, the organization had to obtain consent to distribute such photos in accordance with the law.

This case shows how important it is to clearly understand the boundaries of responsibility of medical institutions and their employees in the field of personal data protection.
