Pensioner in the Volgograd region challenged the fine for sand and tires at home
The decision to bring an elderly citizen to administrative responsibility was canceled due to the lack of proper notification of the venue of the meeting

As reported in the Frolovsk city court of the Volgograd region, in September of this year, a protocol was drawn up against a local resident for storing sand and car tires near his house. The administrative commission of the city of Frolovo fined the pensioner 3000 rubles under article 8.7 of the Code of the Volgograd region on administrative responsibility.
The man did not agree with this decision and filed a complaint with the court. He explained that the building material was brought for repair work, and he could not transfer it immediately to the yard because of his old age and poor health. Tires were used as a forced measure to keep debris from emergency trees, which city services have not cut down yet.
Serious procedural violations by officials were revealed during the proceedings. The minutes indicated that the meeting of the Commission will be held at one address, but in fact it was held in a completely different place. At the same time, members of the commission could not provide any evidence that the pensioner was duly notified of the change in the address and time of the meeting.
The court stressed that the consideration of an administrative case in the absence of a citizen without his timely and correct notification is a gross violation of the law. This deprived the elderly person of the legal right to defense, the opportunity to give personal explanations and provide evidence.
In this regard, the decision of the Commission was declared illegal. Since by the time of the trial, the statutory limitation period for bringing to justice had already expired, the proceedings in the case were finally terminated without the possibility of sending for a new trial. The fine has been reversed completely, the court decision has not yet entered into legal force.
