Dzerzhinsky District Court Perm ruled on a dispute between an entrepreneur and a client who demanded the return of 500 thousand rubles for an online mentoring course. This was reported in the press service of the Perm regional court.
A resident of the regional capital purchased a course worth 500 thousand rubles at the expense of credit funds. The program included a strategic session, access to materials, group and individual meetings. Two months later, the plaintiff demanded the money back. In her opinion, the services were of poor quality, the classes were superficial, the materials had no practical value, the expected result she did not receive. Having received a refusal, the plaintiff appealed to the court with a demand to return the payment, recover a penalty, compensation for moral damage and a fine under the Law “On Protection of Consumers”.
The court found that at the time of the conclusion of the contract, the plaintiff herself was registered as an individual entrepreneur and purchased a course not for personal needs, but for entrepreneurial activity. Therefore, the Consumer Protection Act does not apply in this case.
The materials of the case confirm that the executor fulfilled his obligations. The plaintiff was given access to materials and a chat room, a strategy session, an individual meeting and ten online group meetings. The plaintiff actively participated in them, received advice from mentors, thanked for useful materials and reported in a chat about the concluded sale. The court rejected the arguments about the non-compliance of the course with the stated goals as not supported by evidence.
In addition, the court noted that such a course is not an educational activity, since it does not implement educational programs. Therefore, the license was not required.
The court denied the claim in full.
The decision has not entered into legal force and can be appealed to the Perm regional court.
