The Caspian city court recovered from the developer more than 1 million rubles for violation of the terms of transfer of the apartment to the equity holder. This was reported by the joint press service of Dagestan courts.
It was established that the developer violated the deadline for the transfer of the shared construction object to a resident of Kaspiysk, provided for by the contract. The apartment with an area of 28.40 square meters in a residential complex in Yuzhny Butovo in Moscow was to be transferred no later than June 30, 2025, but the act of reception and transfer was signed only on March 23, 2026.
The court refused the developer to postpone the execution of the decision, indicating that support measures under the decree of the government of the Russian Federation No. 326 do not apply to claims filed in 2026, and the defendant did not provide evidence of property difficulties.
The court granted the claim and recovered from the defendant 1,072,280 rubles; the rest of the claims for compensation for moral damage were denied.
