The court appealed to the Department of Education of the administration of one of the districts of the capital about the deprivation of parental rights of the mother and father in respect of four boys (2018, 2020, 2022, 2023) and a girl (2023). At the same time, a court decision made in 2025 denied the deprivation of parental rights of spouses, and the mother and father warned about the need to change their attitude to the upbringing and maintenance of minors. However, after the return of the children to the family, they were again recognized as being in a socially dangerous position, and subsequently in need of state protection. The children were taken from the family to an orphanage.
- Due to alcohol abuse, parents did not create proper conditions for the living and development of minors, they systematically did not have food and cooked food at home, said Karina Kruk, the prosecutor of the Minsk Prosecutor’s Office for Supervision of Compliance with Law of Court Decisions on Civil Cases. Since the recognition of brothers and sisters in need of state protection, their mother and father did not take measures to eliminate the reasons that served as the basis for the removal of their children, the recommendations of specialists were not fully implemented.
Defendants continued to evade parental responsibilities and to lead lifestyles that did not correspond to the normal development and upbringing of the children, adversely affecting their physical and mental state.
In court, the claims of the parents did not recognize. They indicated that they love children and want to return them to the family, taking measures to overcome addiction to alcohol.
Taking into account all the circumstances and interests of minors, as well as in view of the existence of the grounds provided for in Art. 80 of the Marriage and Family Code, the prosecutor expressed the opinion on the need to satisfy the claims.
The court ruled on the deprivation of parental rights of residents of Minsk in respect of five children.
The decision was appealed by the defendants, but remained unchanged and entered into legal force.
- Deprivation of parental rights is an exceptional measure of protection of children, which is applied by the court only in extreme cases, K. Crook noted. The mother and father may be deprived of parental rights on the grounds provided for in Part 1 of Article 80 of the Marriage and Family Code, if their guilty behavior is established. This list of grounds is exhaustive.
Cases of deprivation of parental rights are considered with the mandatory participation of the prosecutor and a representative of the guardianship and guardianship authority.
