Named the condition under which the goalkeeper Ovono can be in prison

According to the newspaper Marca, citing criminal lawyers Blanca Alguasil and Maria Barbancio, the goalkeeper of the club “Andorra” Jesús Ovono can face up to four years in prison because of the collision with Jesus de Miguel, which led to the death of the player of the Spanish “Tenerife”, but only in the case of criminal prosecution.

Alguasil recalled that Article 142 of the Spanish Criminal Code deals with causing death by negligence and provides for two types of liability: for a serious act - imprisonment for a term of one to four years, and for an act of lesser gravity - a monetary fine, the amount of which is determined on the basis of income for a period of three to eighteen months. At the same time, the mere existence of such an article does not mean that a specific action will necessarily be qualified as a criminal offense.

According to her, criminal law cannot judge the existence of a crime based solely on the severity of the consequences. If an investigation is initiated, it is the judge who, after examining the evidence and circumstances of the case, will determine whether there are sufficient grounds for criminal prosecution, and until then any legal qualification would be premature.

The lawyer also pointed out that, on the one hand, a sports violation has already been recorded in the judge’s protocol, and it will be considered by the relevant sports committees, and on the other hand, the question of whether this can turn into a criminal case and whether it is related to criminal law at all is a completely different topic. She stressed that final legal conclusions cannot be drawn before the criminal investigation is completed.

Barbancio, in turn, drew attention to the degree of risk that participants in contact sports consciously take. She explained that football is a contact sport, and players are well aware that you can get such blows on the field, which in ordinary life would be unthinkable.

Earlier it was reported that the legend of the NHL Gretzky commented on the decision of Canada on hockey players from Russia.
