In 2022, the bank demanded to recover about 300 thousand rubles from Javadova under a loan agreement allegedly concluded in 2013. The court found that the credit institution did not provide sufficient evidence of the conclusion of the contract and the woman’s receipt of money, and refused to recover. The bank did not appeal the decision and it came into force. However, the debt continued to be listed in the woman's credit history.
The bank charged interest and penalties, and in the spring of 2024 refused to correct the information, saying that the debt was not repaid. Later, the credit institution sold the debt to collectors, who began to demand payment from Javadova. The woman suggested that the debt could arise from bank assets transferred between the organizations after the withdrawal of Privat Bank from Russia in 2014.
According to her, at one stage she was issued a credit card without a contract. Javadova again appealed to the court, demanding to recognize the debt missing, and the actions of the bank illegal, but lost. The appeal and cassation courts supported this decision.
The Supreme Court pointed to a contradiction between the judicial acts, overturned the decisions of three instances and sent the case for review. During the re-examination, the court recognized the debt as absent, and the accrual of debt and its sale to collectors were illegal. From the bank and collectors recovered 30 thousand rubles. compensation for moral damage, as well as almost 60 thousand rubles. court costs.
