The court in Kostroma denied the driver compensation for the flooded car
In Kostroma ended the trial in the resonant case of a flooded car

In Kostroma, the trial in the resonant case of a flooded car was completed. A resident of the city demanded from the administration to compensate the damage in the amount of 738 200 rubles, which his car received in June on the street Radiozavodskaya. After a heavy rain, the street turned into a river, the water got into the cabin and the hood space, disabling electronic boards.
The car owner was sure that a deep puddle was formed due to clogged storm sewers and improper maintenance of roads. However, the Sverdlovsk District Court examined the circumstances of the case in detail and sided with the municipality.
Several key facts emerged during the proceedings.
On the day of the incident in Kostroma fell 80% of the monthly rainfall. The court recognized this as a force majeure weather phenomenon, with which the regular drainage system could not physically cope instantly.
Storm sewerage worked properly, there were no regulatory grounds for its unscheduled cleaning at that time.
The main argument was the technical documentation of the car itself. The manufacturer allows overcoming water obstacles with a depth of up to 50 centimeters, but only under two conditions: movement at low speed and the use of increased ground clearance.
The court concluded that the driver, seeing extreme weather conditions, had to exercise caution: choose a different route or refuse to travel. By failing to do so, he committed gross negligence, which led to a hydraulic shock and a bay of electronics.
Since the plaintiff’s direct fault was established in the breakdown, and illegal actions by the administration were not revealed, the claim was denied. The court decision has entered into legal force.
