Volgograd residents were given advice on what to do if the price on the shelf does not match the check

Volgograd residents were reminded how to protect their rights if the price of goods at the checkout did not coincide with the price tag. According to Article 494 of the Civil Code of the Russian Federation, the price tag is considered a public offer, so the store is obliged to sell the goods at the cost indicated in the trading room.

References of the seller to the fact that the share has ended or the price tags did not have time to replace, do not relieve him from liability. To monitor the relevance of prices is the responsibility of the store, not the buyer, notes the portal “Explain.rf”.

Before payment, you need to inform the cashier about the discrepancy and demand to break through the goods at the price from the price tag. In case of refusal, you should contact the administrator or manager. If this does not help, the buyer has the right to demand a book of reviews and suggestions, where you need to fix the date, time, name of the goods and the difference between the price at the checkout and on the price tag.

If the goods have already been paid, it is necessary to photograph the price tag and save the check - this is the main evidence. In the review book, you should leave contacts: phone and email address, to which the store is obliged to respond.

To return the overpayment, you can send a written claim to the head of the outlet. To address should attach a copy of the check, a photo of the price tag, and when paying with a card - a bank statement. It is important not to take the price tag with you: the administration may regard this as theft.

If the store refuses to return the money, you should contact the territorial authority of Rospotrebnadzor. For violation of consumer rights, a legal entity faces a fine from 100 thousand to 500 thousand rubles.

The buyer also has the right to go to court. In addition to the return of the difference in price, he can claim compensation for moral damage. In addition, the court can recover from the seller a fine of 50% of the amount awarded if he refused to settle the dispute voluntarily.
