An employee of the Research Institute of Television in St. Petersburg through the court challenged the dismissal for regular delays and achieved return to work, as well as compensation for a total of 871.6 thousand rubles. The third court of cassation left the decision in his favor unchanged.
The man worked at the Institute since 2019. In February and March 2025, he came to work several times 30-40 minutes later. The employee did not provide any valid reasons for the delay, and refused to give written explanations.
During this period, the management announced to the electrician comments for violation of business ethics and improper storage of official documents, as well as reprimanded for lateness. In March, the employee was fired for repeated failure to perform work duties.
The man went to court. Initially, the decision turned out to be in favor of the employer, but the appeal court overturned it, considering that several disciplinary sanctions were imposed on the employee in a short time, without providing an opportunity to correct the situation.
The fact of violations of labor discipline was not disputed. The court found that the employer had not confirmed that the severity of the misconduct, the previous conduct of the employee and his attitude to work had been taken into account when choosing the punishment. The sequence of penalties also allowed the appeal to see the desire of the management to get rid of the employee.
As a result, the man was reinstated in office. From the enterprise recovered 851.6 thousand rubles for the period of forced absenteeism and another 20 thousand rubles as compensation for moral damage. The employer tried to appeal this decision, but on August 3, 2026 the Third Court of Cassation upheld it.
Earlier in St. Petersburg, the general director called the ex-employee a “ladyr” and received a fine.
Also in the Netherlands dismissed employee sued the company 5.7 million rubles.
