In the Volgograd region, the court sided with a health worker in a pension dispute
A woman should be given an early pension.

The Frolovsk city court of the Volgograd region recognized as illegal the refusal of the OSFR in the region in the appointment of early pension of their health worker. The woman for more than three years could not receive the due payments. This is reported by the joint press service of the courts of the Volgograd region
The reason for the dispute is the period of work from November 1995 to October 1999 as a nurse of the surgical department. OSFR did not want to count it in a preferential calculation (a year and a half), referring to the absence of the employer staffing and job description for the 90s.
The court considered this argument insufficient: the lack of personnel documents does not cancel pension rights, if the work is confirmed by other evidence. By law, preferential experience is given not only to surgeons, but also to the average medical staff of surgical departments of hospitals. The fact of a woman’s full-time work was confirmed by the entries in the employment record book and the employer’s certificate. In addition, the pension authority itself had previously counted this period into the usual length of service - thereby actually confirming both the nature of work and the status of the medical institution.
Taking into account preferential calculus, the necessary length of service was worked out by November 1, 2020, and the right to an early pension arose on November 1, 2022. Since the application to the OSFR was received on September 6, 2023, the refusal to pay was found unreasonable.
According to the court, the OSFR is obliged to recalculate the experience in a preferential manner and assign an early pension to the woman from the date of application - from September 6, 2023. The decision has not yet entered into legal force.
