Minsk realtors told about the subtleties of removal from registration in the apartment when selling housing
When selling an apartment, moving or resolving personal issues, the owners often have a question: is it possible to leave the house if a new place of registration is registered.

When selling an apartment, moving or resolving personal issues, owners often have a question: is it possible to leave the house if there is no new place of registration yet? About the intricacies of the implementation of such transactions told sb.by in the Minsk Agency “Vanguard Real Estate”.

In Belarus, the word “registration” has been officially replaced by the concept of “registration at the place of residence” – it confirms that a person lives somewhere permanently, and is mandatory for citizens who are in the country on a permanent basis. When changing the place of residence, registration is first made at a new address, and withdrawal from the former place is automatic.
- Registration at the place of residence confirms the official address of the person’s residence, so it is usually impossible to simply check out of the apartment and remain without registration, the realtors stressed. When moving, you must register at a new address, except in cases provided for by law. For example, if a person permanently resides outside Belarus and has the relevant documents or if the citizenship of the Republic of Belarus is terminated. When there are no such grounds, registration at the new place of residence is required.
What to do if you need to sell an apartment, but there is no new housing yet? For example, the owner wants to sell the apartment, but has not yet managed to buy a new one. Experts recommend solutions to the problem. The first is to sell the apartment without prior discharge. The law does not necessarily require deregistration prior to the transaction. In the contract of sale, you can specify the conditions that the seller does not retain the right to use the apartment after sale, as well as determine the terms of removal from registration. The second option is to issue a temporary registration: for the period of searching for new housing, you can agree on registration with relatives or friends or use other available options for temporary residence. Finally, the third option is to first buy a new home and then sell the old one. This trajectory avoids registration issues, but requires additional financial resources.
- There is no mandatory pre-existence before sale, experts noted. In the contract of sale you can prescribe the conditions that govern the procedure for deregistration of the former owner and other tenants.
By the way, if a person is in another city or country and cannot come in person, then the issue with an extract can be resolved through a representative of the General Power of Attorney. The document should clearly indicate the authority to deregister.
- Independently check out of the apartment “to nowhere” in Belarus is usually impossible, — said the realtors. However, depending on the situation, you can choose a legal solution: register at a new address, use temporary registration. If the situation is unusual, it is better to consult with specialists in advance - this will help to avoid difficulties in real estate transactions. Minsk realtors state a gradual increase in the number of offers in the housing market
