The builder from Grodno was recalculated severance pay after 15 years of his work were not taken into account when determining the length of service at the enterprise. Thanks to the intervention of the regional organization of the Belarusian Trade Union of Construction and Construction Materials Workers, the amount of payment increased by 2.3 thousand rubles.
The man worked in the organization for 42 years. When he was going to retire at a generally established age, he counted on the severance pay provided for by the collective agreement. Its size depends on the length of service in the enterprise.
However, at the initial calculation, 15 years were not included in the seniority. The man since 1998 received a disability pension after participating in the liquidation of the consequences of the Chernobyl accident. This date was considered the end of the period to be taken into account when calculating the benefit, although the employee continued to work.
The situation was helped by the legal labor inspector of the regional organization of the branch trade union Dmitry Demyanovich.
The incident occurred due to an incorrect interpretation of the collective agreement, according to which the length of service is calculated “at the time the employee reaches retirement age.” The key wording here is “retirement age.” The pension that a man received since September 1998 can be equated with social benefits associated with disability. But this does not mean retirement age. Therefore, it is necessary to take into account all the time the man works in the organization, he explained.
The company listened to the arguments of the trade union specialist and conducted a recalculation. As a result, the experience increased by 15 years, and the amount of severance pay – by 2.3 thousand rubles.
