The procedure for granting leave with the subsequent dismissal of an employee provides for compliance with a number of rules and conditions by personnel services. Details were shared with sb.by in the press service of the Ministry of Labor and Social Protection of Belarus.

The press service said:

- The possibility of using a work leave with subsequent dismissal is provided provided that the work leave or part of it was planned in the schedule of work leave or the parties - the employer and the employee - reached an agreement on the granting of such leave. In other cases, the possibility of using leave with subsequent dismissal is excluded.

If the employee wants to use the leave before dismissal, he must write two applications: on granting work leave followed by dismissal and on dismissal indicating the grounds for dismissal. At the same time, personnel officers need to check the grounds for dismissal. Such a procedure is possible, for example, upon dismissal at will, by agreement of the parties, in connection with the expiration of the term of the contract, the employment contract (the leave is granted within the term of the contract or the employment contract), as well as on other grounds not related to the guilty actions of the employee.

- In case of dismissal for guilty actions (for discrediting circumstances), such leave is not provided, the ministry stressed.

It is also necessary to determine the unused vacation days (take into account the unused days of work - the main and additional - vacations or parts thereof), determine from what day the employee goes on vacation and how many days he uses.

Another important point: the day of dismissal is the last day of leave, not the last day the employee was actually at work. For example, on vacation from 5 to 31 October, the date of dismissal is October 31.

- It is also necessary to issue orders on granting leave and dismissal, and in the documents on dismissal indicate the last day of leave, the Ministry of Labor and Social Protection added. After that, the final calculation is made and a work book is issued. At the same time, all amounts due to the employee must be paid no later than the day of dismissal. For days of work leave that a person does not use, monetary compensation is paid. Calculation and issuance of the work record must be carried out in due time: on the last day of work or on the day of dismissal, that is, the last day of leave.
