A resident of Bobrov will return almost 92 thousand rubles for a smartphone with an Indian guarantee

A resident of Bobrov, Voronezh region has achieved through the court a refund of money for a faulty smartphone Samsung Galaxy S26. It turned out that warranty service of the device was provided only in India, although this was not reported in the product card on the marketplace. This was reported on October 9 in the joint press service of the courts of the region.

The woman bought the phone for 91 831 rubles, using the installment service “Yandex Split”. However, six days after the purchase, she discovered the problem and decided to return the device.

Later, the buyer learned that it would not be possible to apply for a guarantee to a Russian service center: service was available only in India. Since this information was not indicated during the purchase, the woman appealed to the court.

In addition to the cost of the smartphone, she demanded to reimburse interest on the loan, compensate for moral damage and legal costs, as well as recover a penalty and a fine.

The court granted the claim in part. From the entrepreneur recovered 91 831 rubles for the phone, more than 13 thousand rubles of interest, 5 thousand rubles of compensation for moral damage instead of the requested 100 thousand, as well as 8 thousand rubles of court costs. The claim for compensation was denied.

In addition, the seller must take the smartphone at his own expense after returning the buyer money.
