From the court documents, it is known that the plaintiff was Cargill LLC, a large manufacturer of starch, refined sunflower oil and other food products. The lawsuit against the Regional BTI and the Government of the Tula Region was filed by the company in February this year.

The company was the owner of a large land plot in the Efremovsky district of the Tula region. This plot is used for the production needs of the enterprise and belongs to the category of lands of settlements with permitted use for production purposes.

The object itself is located more than 80 kilometers from Tula. Its exact location, as well as the cadastral value, are not clear, since all this data was withdrawn from the court decision before the publication. The text mentions the specific cost - 377 rubles / sq. meter (the range of analogues 152-610 rubles / sq. meter, an average of 424 rubles / sq. meter). In addition, the cost of a similar land plot with an area of 2 thousand square meters, which was estimated at 10 million rubles, is indicated.

Meanwhile, you can find out that the cadastral value of the site was determined based on the results of the state cadastral assessment as of January 1, 2022 and approved by the government of the Tula region. From 1 January 2023, this information is used for tax purposes.

In October 2025, the company applied to the Regional BTI with an application to establish the cadastral value in the amount of the market. An assessment report was attached to the application, according to which the market value of the site as of September 11, 2025 was significantly lower than the cadastral value.

However, on November 14, 2025, the institution refused to satisfy the application, pointing to violations of the requirements of the legislation on valuation activities in the preparation of the report.

Cargill LLC challenged this refusal in the Tula Regional Court. The company also asked to restore the deadline for applying to the court, but the court concluded that the deadline was not missed, since the notification of the BTI decision was received on November 19, 2025, and the claim was sent to the court on February 17, 2026.

Strange decision

The case was considered in open session. The representative of the plaintiff supported the claim, the representative of the GU TO “Regional BTI”, on the contrary, objected to the satisfaction of the claim. The court appointed a forensic examination, the results of which played a key role. The expert confirmed that there are some shortcomings in the report on the valuation of the site. However, they are formal in nature and do not affect the final result of determining the market value. The expert confirmed the market value of the site calculated by the appraiser.

The court analyzed in detail the objections of BTI concerning the correctness of the choice of objects-analogues, the validity of adjustments to the auction, the location and provision of communications, the comparability of one of the analogues, which was in the territorial zone, which formally did not provide for production activities.

On all these points, the court agreed with the expert's conclusions. The shortcomings were recognized as formal. The court stressed that the refusal of the budgetary institution cannot be based solely on formal comments, if they did not affect the reliability of the final cost. This approach, according to the court, contradicts the positions of the Constitutional Court of the Russian Federation and the explanations of the Supreme Court of the Russian Federation about the inadmissibility of a formal approach in the exercise of public powers.

As a result, the court recognized the decision of the Regional BTI of November 14, 2025 as illegal and established the cadastral value of the land plot equal to its market value as of September 11, 2025. In other words, the cost of the site was reduced.

Revenue for 2025 - 96 billion rubles, the owner - Cargill International Luxembourg. The main industrial complex is located in the city of Efremov. On the territory of the plant there are several large land plots, where production and warehouses are located.

In particular, there is a site for receiving, purifying and storing grain (elevator complex), a site for the production of starch products and molasses (formerly Glucose-Stick Plant "Efremovskiy"), a site for refining and packing vegetable oils. In addition, there is a plant for the production of pre-starter feed and concentrates for livestock.
