Can a vacation burn out? The Ministry of Labor of Belarus explained the rules
Replace part of the holiday with money without dismissal by agreement of the parties. What conditions must be observed and for whom prohibitions are established, the Ministry of Labor said.

Labor leave in Belarus can not “burn out”, and replace it with money without dismissal is possible only in strictly defined cases. This was told on the air of the TV channel “First Information” by the consultant of the main legal department of the Ministry of Labor and Social Protection Tatiana Rahubo.
The right to rest is guaranteed by the Constitution and the Labor Code, so the accumulated days do not disappear. If the employee refused to rest, the opportunity to use it is physically excluded, however, upon dismissal, the person will necessarily receive the final calculation for all calendar days of leave, regardless of their number.
Replace part of the holiday with monetary compensation, without dismissal, is possible only by agreement of the parties and provided that in the current working year the employee has already rested at least 21 calendar days. Only those days that exceed this threshold can be compensated. At the same time, the law protects vulnerable categories: pregnant women, disabled people, minors, as well as employees working in harmful conditions or in the Chernobyl pollution zone, the replacement of vacation with money is prohibited.
Compensation is also possible with early withdrawal from leave at the initiative of the employer, but only with the consent of the employee. Minors and persons working in harmful and dangerous conditions cannot be recalled from rest. If by the time of withdrawal the person managed to walk at least 14 calendar days, the issue of compensation for the balance may be raised.
As for planning, the holiday schedule is usually approved until January 5. In force majeure situations, the employer can provide at least 14 days of rest, and the remainder can be transferred to the next year. However, employers are obliged to grant full leave to minors and workers in harmful working conditions annually.
