One of the vessels to the ex-contractor of the Orel overpass in Tula stopped
The Arbitration Court of the Lipetsk region at the end of September of this year ruled on leaving without consideration two counterclaims related to the execution of the state contract for road works

Not appearing in court
From the court documents, it is known that LLC UPMK No22 demanded to recover 68.25 million rubles of unforeseen expenses and costs under the contract dated August 19, 2022, as well as court expenses from OKU Road Agency of the Lipetsk region. In turn, the defendant stated counterclaims against the contractor to recover 79.48 million rubles. Of these, 64.1 million rubles - unworked advance, which was considered unjust enrichment, 15.32 million rubles - penalty for delay in fulfilling obligations from March 2 to June 24, 2025.
The cases were combined into one proceeding. The Federal Autonomous Institution “Russian Road Research Institute” was involved as a third person.
The court left both claims without consideration, as the parties and the third person repeatedly failed to appear in court sessions (including August 24, September 2 and September 8, 2026). The reasons why they did not come were not stated. However, the judge noted that leaving the claim without consideration does not prevent re-applying to the court after eliminating the circumstances that led to such a decision.
The state duty is subject to return, 816 thousand rubles will be returned to LLC UPMK-22 and 922.2 thousand rubles will be transferred to the Road Agency of the Lipetsk region. Also, from the deposit account of the court, the contractor will be returned 155 thousand rubles, contributed to the examination, which never took place.
Return of the guarantee
However, in the Arbitration Court of the Tula region for LLC UPMK No22, apparently, everything is just beginning.
From the court documents, it is known that the Department for Transport and Road Management of the Tula City Administration filed a lawsuit against First Client Bank LLC from Moscow. A third party was involved in the process LLC UPMK No22.
The Department for Transport and Road Management requires to recover from LLC "First Client Bank the amount under the bank guarantee of March 24, 2025 in the amount of 160 million rubles, including unpaid advance payments in the amount of 159.8 million rubles and a fine of 200 thousand rubles. It cannot be excluded that this process is related to the reconstruction of the Orel overpass in Tula.
The contract with LLC UPMK No22 for the reconstruction of the Orel overpass for 813 million rubles was terminated in August of this year. This was announced by Deputy Governor of the Tula region Vladimir Tsibulsky. According to him, to date, the readiness of the facility is only 44.7%. The truth that something is wrong with the reconstruction of the Orel overpass, our editorial staff became aware in the spring of 2026, when all work at the facility simply stopped.
Recall, as previously wrote “MK in Tula”, in 2026 to the company “UPMK No22” repeatedly filed lawsuits, including the recognition of the company as bankrupt.
For example, the claim for declaring the company bankrupt was filed on May 26 this year by the Interdistrict IFNS of Russia No. 20 in the Saratov region. The debt of LLC UPMK No22 on taxes and fees amounted to more than 46 million rubles. And for some reason, no one was alarmed by this fact.
In addition, there is a lawsuit with the ICU “United municipal customer of the city of Orel”. The municipal institution demanded to recover more than 103 million rubles from UPMK-22 LLC.
In the process of bankruptcy of LLC UPMK No22, claims have already been made to the company by MIFNS No20 of the Saratov region, LLC Technical Center for Road Traffic Organization, Association of Arbitration Managers Eurasia, LLC IC Leia, LLC Vi Cyber.
The company, which did not hand over the Oryol overpass in Tula even half, is currently surrounded by lawsuits from all sides. It is possible to recover the advances spent, but every month the downtime costs residents more than any claims.
MK in Tula is monitoring developments.
