The court found illegal the refusal to return the doors that did not fit Tambovchanka color
The buyer purchased interior doors from an individual entrepreneur, indicating the color “white” in the order

The buyer purchased interior doors from an individual entrepreneur, indicating the color “white” in the order. However, upon receipt of the goods, she found that the shade of the product was beige. The woman demanded to terminate the contract, but the entrepreneur refused, citing the fact that the goods are made according to an individual project and are not subject to return.
The first and appellate courts sided with the buyer. They indicated that the contract was a retail sale of a standard product and not a contract. Interior doors are not included in the list of goods that cannot be exchanged. Consequently, the consumer had the legal right to refuse the goods that did not come in color, on the basis of Art. 25 of the Law on Consumer Protection.
The court of appeal agreed with the conclusions of the court of first instance, the complaint of the individual entrepreneur was left without satisfaction.
